Jerozolimskie 96, 00-807 Warsaw), phone: +48 22 592 70 00, fax: +48 22 597 70 79, entered into the Register of Entrepreneurs kept by the District Court for the Capital City of Warsaw, 12th Commercial Department of the National Court Register, under KRS number: 0000021314, Tax Identification Number (NIP): 525-15-77-627, with a share capital of PLN 36,000,000.00, paid in full. Medicover Sp. z o.o. is represented by its management board.

GLOSSARY

Activation of authorisation – the Beneficiary’s acquisition of authorisation to use the Services purchased at the Online Store.
Beneficiary (Patient) – the Customer or a person entitled to use the Services purchased at the Online Store by the Customer.
Medicover Hotline – a hotline available at +48 500 900 505, through which it is possible to place an Order, receive support in the purchasing process and obtain information about the Goods and Services offered at the Online Store.
Product Data Sheet – the description relating to the Goods, Services or Packages of Services, available within the Online Store.
Customer – a natural person who has full legal capacity and uses the Online Store, in particular by making purchases for their own or someone else’s benefit.
Cart – a functionality of the Online Store, enabling the Customer to display the Services or Goods selected by him/her for purchase, as well as to enter and modify the order data, such as: the number of selected Services and/or Goods, invoice details, method of payment, place of using the Services, place of delivery, the Customer’s data.
Medicover – Medicover Sp. z o.o. with its registered office in Warsaw (address: Al. Jerozolimskie 96, 00-807 Warsaw), phone: +48 22 592 70 00, fax: +48 22 597 70 79, entered into the Register of Entrepreneurs kept by the District Court for the Capital City of Warsaw, 12th Department of the National Court Register, under KRS number: 0000021314, Tax Identification Number (NIP): 525-15-77-627.
Package of Services – a set of Services or other benefits available to the Beneficiary, constituting a certain whole, which can be purchased for a price indicated in the Online Store and used at a specific time and place.
Payment Processor – an entity external to Medicover, which acts as an intermediary in processing payments.
Purchase Confirmation – an email sent by the Online Store to an address indicated by the Customer (during an online completion of an electronic form in the Online Store), confirming that the ordered service can be provided and the goods can be delivered.
Online Store – the online store operated by Medicover, available at medicover.pl.
Service – a service sold at the Online Store, described in detail in the Product Data Sheet.
Order – a declaration of the Customer’s intention to purchase selected Service or Goods at the Online Store, expressed by adding such Service or Goods to the Cart and proceeding to the next step – “Order and pay”.
Goods – a product sold at the Online Store, described in detail in the Product Data Sheet.

GENERAL PROVISIONS

2.1 These Terms and Conditions set out:

the rules of using the Online Store;
the terms of placing Orders for Services and Goods offered by Medicover and the Sellers at the Online Store;
the rules of making payments for the Services or Goods purchased by the Customer at the Online Store;
the Customer’s right to withdraw from an agreement for the purchase of Services or Goods;
the rules of filing and handling complaints.

2.2 In order to use the Online Store (e.g. view the range of available Goods and Services), it is necessary to have access to an end device which is connected to the Internet and has a current version of a web browser installed (such as Microsoft Edge, Google Chrome, Mozilla Firefox, Opera or Safari). In addition, an active email account or phone number is required to be able to use some of the functionalities of the Online Store and place Orders.

2.3 When using the Online Store, it is forbidden for the Customers to provide unlawful content that violates the principles of law or good conduct. Moreover, the Customer is obliged to refrain from any activity which could have a negative impact on the proper functioning of the Online Store, including, in particular, any interference with the content of the Online Store or its technical elements. It is also forbidden to use the Online Store for any purposes which are not in line with its intended use, such as sending spam or carrying out any commercial, advertising or promotional activities within the Online Store.

2.4 The Goods and Services available at the Online Store can be sold only to natural persons who are consumers within the meaning of the law. Any entities which are not considered consumers within such a meaning may purchase Goods and Services using other sales channels operated by Medicover. Information on the rules for non-consumers to purchase Goods and Services from Sellers may be obtained by contacting them directly.

2.5 By making purchases at the Online Store, the Customer confirms that he/she has full legal capacity.

2.6 Browsing the range of Goods and Services available at the Online Store by the Customer and placing Orders for them does not require registration.

2.7 To place an Order for Services or Goods available at the Online Store, it is necessary to fill in an order form with the data specified in clause 4.4 of these Terms and Conditions. The order form can be found within the Online Store.

2.8 Placing Orders is also possible via the Medicover Hotline. In such a case, the Customer will be asked to read these Terms and Conditions and the Privacy Policy. Then, a Medicover Hotline consultant will guide the Customer through the process of placing the Order, which is described in the further part of this document.

2.9 Settlement of the purchase transactions concerning the Goods and Services shall be carried out via the payment systems indicated in clause 5.2 hereof and in accordance with the information provided at the Online Store.

INFORMATION ON GOODS AND SERVICES

3.1 Information on the Goods and Services available at the Online Store constitutes an invitation to conclude an agreement within the meaning of Article 71 of the Civil Code.

3.2 A detailed description and the conditions of use of available Goods and Services can be found in the Product Data Sheets assigned to them.

3.3 The prices of the Goods and Services are indicated in the Polish currency (PLN) on the subpages of the Online Store. The total cost of the Order (i.e. the prices of all Services and Goods included in that Order) is displayed in the Cart before the Customer places the Order. All prices include VAT.

3.4 Medicover reserves the right to modify prices and types of Goods and Services on an ongoing basis.

TERMS OF PLACING ORDERS AND THEIR EXECUTION

4.1 The Customer can place Orders for Goods and Services at the Online Store for 24 (twenty-four) hours a day, 7 (seven) days a week, subject to prohibitions or restrictions of trade resulting from mandatory provisions of law as well as technical breaks.

4.2 Placing Orders with the assistance of the Medicover Hotline consultants is only possible during its working hours (Monday-Friday: 08:00-20:00, weekends and bank holidays: 08:00-18:00).

4.3 Medicover shall not be liable for the quality of the Customer’s Internet connection at the time of making any transactions at the Online Store as well as for any software errors or other defects of the Customer’s end device.

4.4. To place an Order, the Customer has to select the Service or Goods that he/she wishes to purchase and follow the subsequent steps of concluding the transaction, in particular:

complete the order form with first and last name, sex, date of birth, PESEL or passport number, telephone number, address of residence, correspondence address and email address;
accept the terms and conditions regarding the Services as well as the rules of their provision;
should an invoice be required – enter relevant invoice details (if they are different from the data provided for the purpose of receiving given Goods or Services by the Beneficiary);
select the payment method;
click on the “Order and pay” button.

4.5 Orders and Services will be carried out exclusively within the territory of Poland.

4.6 For an Order to be considered correctly placed, the Customer needs to appropriately specify the Goods or configure a Service, in accordance with the guidelines available in each dedicated Product Data Sheet, and make the full payment.

4.7 The Customer is obliged to provide the data indicated in clause 4.4 above completely and accurately, as they are necessary to create an Order.

4.8 In the case of Goods and Services that do not require booking an appointment, an Order is not considered placed by the Customer if the payment for said Service or Goods is not received within 30 calendar days of filling in the form and sending it to the Medicover server, while in the case of Services which require booking an appointment – if the payment is not received in 15 minutes of completing the form and sending it to said server.

4.9 Medicover may refrain from performing the contract when it is impossible to deliver or involves a risk of damage to Medicover as a result of:

the Customer providing incorrect or false data when placing the Order,
inability to contact the Customer at the telephone number or email address specified in the Order,
a justified suspicion of a crime, offence or other violation of law in connection with the Order.

4.10 The Contract shall be enforceable if the doubts has been clarified or the irregularities have been remedied. Medicover may also terminate the Order if the irregularity is irremediable or if it has not been remedied within a reasonable time. If Medicover terminates the Contract or the Contract is invalid in accordance with the provisions of the Civil Code, the Customer shall receive a refund of the price that has been paid. Such refund shall be considered as equivalent to a declaration by Medicover that the contract has been terminated or a declaration that the Purchase Confirmation has been waived.

MAKING PAYMENTS, CONCLUSION OF AGREEMENTS AND EXECUTION OF ORDERS

5.1 The full amount due for an Order is provided within the summary of each Order. The indicated price represents the total cost of the Services and/or Goods purchased by the Customer.

5.2 Payment for the Order may be made via the payment systems indicated in accordance with the payment method selected in the Online Store.

5.3 The date of conclusion of an agreement is the date of receipt of the Purchase Confirmation by the Customer.

5.4 Activation of authorisation shall take place once the Goods or Services have been purchased and the payment has been made. The activation shall be made in accordance with the date specified in the Product Data Sheet.

5.5 The method of delivery of the Service or Goods is described in each case in the Product Data Sheet, available at the Online Store.

5.6 The scope of the Service, the specification of the Goods and the details of a potential warranty for them (where applicable) are included in the Product Data Sheet.

5.7. As part of the execution or completed Order, the Customer will, upon request, receive an invoice sent to the e-mail address provided by him in the Order.

5.8. The invoice is secured with a one-time password received on the telephone number provided by the Customer when placing the Order.

WITHDRAWAL FROM AGREEMENTS

6.1 The Customer may withdraw from the contract for the purchase of the Goods without giving any reason within 14 days from the date of concluding the contract by sending an e-mail to the address e-dok@medicover.pl or using the online form available on the Online Store website. The consumer bears the direct costs of returning the Goods.

6.2 In the case of Goods delivered in sealed packaging, withdrawal from the purchase agreement shall not be possible once the packaging has been opened.

6.3 It is permissible to withdraw from a Service purchase agreement within 14 days of its conclusion, without giving any reason.

6.4 Medicover Sp. z o.o. guarantees to return the paid amount within 14 working days, to the bank account from which the payment was initiated, without imposing any additional cost on the Customer.

PERSONAL DATA

7.1 Personal data provided by the Customers in the Online Store are processed by Medicover Sp. z o.o., with its registered office at Al. Jerozolimskie 96, 00-807 Warsaw (the Data Controller).

7.2 The provision of personal data by the Customer is voluntary, but also necessary for him/her to purchase Goods and Services as well as use such Services. Medicover processes personal data for the purpose of concluding agreements with the Customer for the sale of Goods and Services purchased by him/her at the Online Store as well as executing such agreements. 7.3 By providing personal data, the Customer declares that such data are in fact his/her own.

7.4 The Customer may only enter the data of the Beneficiaries (including their name, PESEL number, address, telephone number or email address) within the Online Store service if such an action does not violate any applicable laws or personal rights of these persons.

COMPLAINTS

8.1 Questions, suggestions and notifications regarding problems with the Online Store may be submitted in one of the following ways:

by email at e-dok@medicover.pl;
by phone at +48 500 900 505, available Monday-Friday, 08:00-16:00;
by completing an online form available in the Online Store.

8.2 Complaints regarding the service are considered within 10 working days from the date of provision of all data necessary to handle the complaint to the following address: Medicover Sp. z o.o., Dział Obsługi Klienta – Reklamacje [Customer Care Centre – Complaints], Al. Jerozolimskie 96, 00-807 Warsawor by email at e-dok@medicover.pl. The complaints related to the Goods and Services purchased by the Customer and sold by Medicover are handled within 30 working days, under the same conditions.

8.3 In the case of a complaint or claim regarding the performance of a Service or the purchase of Goods, the Customer shall, at Medicover’s request, take appropriate steps to enable Medicover to receive all information necessary for the proper handling of such a claim or complaint.

8.4 The competent court for disputes arising in relation to the agreements for the sale of Goods and Services shall be the court of general jurisdiction.

8.5 Medicover declares that, in accordance with their contracts with telecommunications operators, for a telephone call they should not charge the Customer a price that is different when compared to the price for ordinary telephone calls.

FINAL PROVISIONS

9.1 The Services purchased at the Online Store may not be resold, transferred or lent to a third party without the Seller’s consent.

9.2 Purchased Goods and Services are not exchangeable for any other Services or Goods.

9.3 Purchased Services do not replace Services provided on the basis of a legal relationship other than an agreement concluded via the Online Store.

9.4 The amendment of these Terms and Conditions shall be carried out by publishing the revised text at www.sklep.medicover.pl and shall not affect the performance of agreements concluded prior to said amendment.

9.5 These Terms and Conditions shall enter into force on 19.01.2023.
